1. General Information
The Services are not accessible to children under the age of thirteen. Therefore, by using and accessing the Services, You warrant that You are over the age of 13. If You are under 13 years of age, do not use or access the Services at any time or in any manner. If You are between 13 and 18, You must have the prior written authorisation of Your parent or guardian to use and access the Site and the Platform.
2. Data Collection
“Data” shall mean any information indicated by You voluntarily by using and/or accessing the Services which may include:
Use of the Site: when You use the Site, Data about Your computer hardware and software may be automatically collected by Octoly. This information can include: Your IP address, browser type, domain names, access times and referring Site addresses.
Registration and/or subscription to the Platform: when registering and/or subscribing to the Platform, You will transmit to Octoly Your name, address and email address. Octoly may also collect anonymous demographic information, which is not unique to You, such as Your age and gender.
Social media: If You access or log-in to the Site and/or Platform through a social media or other service or connect the Site and/or Platform to a social media or other service, the information Octoly collects may also include Your user ID and/or user name associated with that social media service, any information or content You have permitted the social media service to share with Octoly, such as Your profile picture, email address or friends lists, and any information You have made public in connection with that social media service. When You access the Site and/or Platform through social media services or when You connect the Site and/or Platform to social media services, You are authorizing Octoly to collect, store, and use such information to perform the Services.
The Data shall not be public unless shared by You within Your Octoly account. Please keep in mind that if You directly disclose personally identifiable information or personally sensitive data through Octoly's public message boards, this information may be collected and used by others. Such disclosure will be made under Your sole responsibility.
You may connect Your Octoly account to third party accounts. By connecting Your Octoly account to Your third party account, You acknowledge and agree that You are consenting to the continuous release of information about You to others (in accordance with Your privacy settings on those third party sites). If You do not want Your Data to be shared in this manner, do not use this feature. You may disconnect Your account from a third party account at any time. Octoly is not responsible for the privacy statements or other content on websites outside of the Site and/or the Platform.
3. Use of the Data
Octoly collects and uses the Data to operate the Site and the Platform and to deliver the Services supplied upon subscription to the Platform, that You have requested and, from time to time, to inform and/or propose to You other products or services available on the Platform. Furthermore, Octoly uses the Data to provide general statistics regarding the use of the Site and the Platform such as to determine what Octoly services are the most popular.
Octoly may also contact You via surveys to conduct research about Your opinion of current services or of potential new services that may be offered.
Your Personal Information will be processed by Octoly in the United States and in the European Union.
4. Transfer of the Data
In order for Octoly to suggest Creator’s profiles to Clients, the name, age and gender of all Creators registered on the Platform will automatically be displayed within the Platform upon creation of a Creator Octoly account.
Octoly may, from time to time, contact You on behalf of external business partners about a particular offering that may be of interest to You. In those cases, the Data (e-mail, name, address, telephone number) will only be transferred to the third party, including without limitation certain information received from Your social media platform login, upon Your prior authorisation.
Octoly may also share the Data with trusted partners to help perform statistical analysis, send You email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using Your personal information except to provide these services to Octoly, and they are required to maintain the strict confidentiality of the Data.
Octoly may disclose the Data, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Octoly or the Site; (b) protect and defend the rights or property of Octoly; (c) act under exigent circumstances to protect the personal safety of users of Octoly, or the public and (d) as necessary to perform the services requested by You.
Other than set forth herein, Octoly does not sell, rent or lease the Data to third parties.
Octoly or third parties authorized by Octoly (such as advertisers and analytics companies), may use tracking technology such as "cookies" to help personalize Your online experience. A cookie is a text file that is placed on Your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to Your computer. You have the ability to accept or decline cookies by indicating Your choice in the cookie banner displayed when connecting to the Site and/or the Platform. If You choose to decline cookies, You may not be able to fully experience the interactive features of the Octoly services or websites You visit.
You can choose to limit Behavioral Advertising on the Site by clicking http://www.aboutads.info/choices/ and opting-out of cookies placed by those vendors listed. After You opt-out, You will still see advertisements but the advertising may not be as relevant to Your interests. If You change Your computer, change Your browser, or delete Your cookies, You will need to renew Your opt-out.
6. YouTube Data
The YouTube Data is collected to (i) confirm Your subscription to the Platform and to (ii) compute statistics regarding Your Octoly activity. Your YouTube Data is stored in Octoly’s servers and shared with Octoly’s privileged partners for statistical purposes.
You can revoke at any time Octoly’s access to Your YouTube Data via the Google security settings page available at the following URL address: https://security.google.com/settings/security/permissions.
7. Security and storage of the Data
Octoly secures the Data from unauthorized access, use or disclosure by unauthorized third parties and ensures that will take all appropriate measures to limit the risk that it may be lost, damaged or misused.
Data is stored on secured third party servers in the USA. The Data is kept only as long as necessary for the purposes set out above. After that point, Data is kept only for statistical and evidence purposes and shall not be used for any other reason. Once such period is expired, the Data is destroyed.
8. Your rights

You can also opt-out of receiving announcements of certain information by following the unsubscribe instructions provided in the promotional e-mail You receive, by choosing Your preferred settings at the following URL address: https://www.octoly.com/creators/settings/notifications or by sending us an email to : email@example.com.
At this time Octoly does not respond to browser 'Do Not Track' signals, as Octoly awaits the work of interested stakeholders and others to develop standards for how such signals should be interpreted.
